Article 1 - Definitions

In these Terms and Conditions of Use (hereinafter "T&Cs"), the terms below have the following meanings:

  • "Content": means all elements constituting the information present on the Website (texts, images, videos, software, algorithms, databases) and enabling its operation.
  • "Publisher": means INOVATECH SOLUTIONS LTD, registered under number 207787211, with its registered office at Jawaharlal Neru n.28, Silver Center, fl.2, office 64. 1324 Sofia, Bulgaria.
  • "Features": means all features made available to Users via the Website.
  • "Services": means the vehicle information reports and associated features offered via the Website.
  • "Website": means the website cargeny.com operated by the Publisher.
  • "User": means any person accessing the Website and using its Features.

Article 2 - Purpose and Acceptance

These T&Cs are intended to define the conditions of access to and use of the Website by Users.

Use of the Website implies full and unreserved acceptance of these T&Cs. Any User who does not accept the T&Cs must refrain from using the Website.

The version of the T&Cs in force is the one accessible on the Website at the time of consultation. The Publisher reserves the right to modify these T&Cs at any time. Modifications take effect upon their publication on the Website.

Article 4 - Description of Services

4.1 Nature of the Services

The Website allows Users to access vehicle information reports, within the framework of a subscription defined by the Terms and Conditions of Sale.

The Publisher strives to provide information that is as accurate as possible. However, the information on the Website is provided for informational purposes only and is not exhaustive. Vehicle reports are based on data from third-party sources that the Publisher does not verify and for which it guarantees neither the accuracy nor the completeness.

4.2 Validity Period of Reports

Each report is a snapshot of the data available on its generation date and is not subject to any automatic update. It has a validity period of one (1) month from that date.

Upon expiry of that period, the report is deemed expired and its content is no longer accessible from the User's account. It is the User's responsibility to download it in PDF format before that term if they wish to keep a copy.

The User may generate a new report for the same vehicle in order to obtain updated data, under the conditions and within the limits set out in the Terms and Conditions of Sale.

Article 5 - Access to the Website

5.1 Conditions of Access

Access to the Website is open to any User with Internet access. Connection costs (equipment, Internet subscription) remain the sole responsibility of the User.

The User undertakes to access the Website with properly functioning equipment, protected against viruses and with an up-to-date browser.

5.2 Availability

The Website is in principle accessible 24 hours a day, 7 days a week. The Publisher nevertheless reserves the right to temporarily suspend access to the Website for maintenance or update purposes. Where possible, the Publisher will inform Users of planned periods of unavailability.

5.3 User Account

Access to the Services requires the creation of an account. The User is solely responsible for the accuracy of the information provided during registration and undertakes to keep it up to date.

The User is solely responsible for the confidentiality and security of their login credentials. Any use of the account is deemed to have been made by the User. In the event of loss, theft, or suspected fraudulent use of their credentials, the User must inform the Publisher without delay via the contact form.

Article 6 - User Conduct

The User undertakes to use the Website in accordance with these T&Cs and applicable legislation. In particular, the User shall not:

  • use the Website in a manner that impairs its proper functioning or security;
  • introduce viruses, malware, or any unlawful content on the Website;
  • attempt to gain unauthorised access to the Publisher's computer systems;
  • use the Website for unauthorised commercial solicitation;
  • systematically extract data from the Website by automated means (scraping, bots, etc.).

Article 7 - Intellectual Property

7.1 Publisher's Rights

All elements composing the Website (texts, images, graphics, logos, icons, software, databases, Website structure) are protected by applicable intellectual property laws and are the exclusive property of the Publisher or its partners.

Any reproduction, representation, modification, publication, distribution, or exploitation, in whole or in part, of these elements, without the prior written authorisation of the Publisher, is strictly prohibited and constitutes infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code.

7.2 Prohibitions

The User shall not:

  • copy, reproduce, or distribute all or part of the Website's Content;
  • create derivative works from the Content;
  • modify, translate, adapt, or arrange the Content;
  • disassemble, decompile, or reverse engineer the Website.

7.3 Trademarks

Article 8 - Liability

8.1 Publisher's Liability

The Publisher undertakes to implement the necessary means for the proper functioning of the Website. However, it does not guarantee that the Website is free from errors or that it is accessible without interruption.

The Publisher shall not be held liable for:

  • malfunctions related to the Internet network, the User's equipment, or third-party software;
  • indirect damage (data loss, loss of opportunity, commercial loss) resulting from the use of or inability to use the Website;
  • the content of third-party websites accessible via hyperlinks on the Website.

8.2 User's Liability

The User is solely responsible for their use of the Website and the Services. The User is also responsible for protecting their computer equipment and data.

Article 9 - Personal Data

Article 12 - Language

In the event of a translation of these T&Cs, the French language version shall prevail in the event of any discrepancy in interpretation.

Article 13 - Applicable Law and Dispute Resolution

These T&Cs are governed by European Union law and, subsidiarily, by Bulgarian law.

In the event of a dispute relating to the interpretation or performance of these T&Cs, the parties undertake to seek an amicable solution prior to any legal proceedings.

Users residing in the European Union may use the online dispute resolution platform of the European Commission: https://ec.europa.eu/consumers/odr.

Failing an amicable resolution, the dispute shall be submitted to the competent courts in accordance with ordinary rules of jurisdiction. For Users acting as consumers, the rules of territorial jurisdiction of their place of residence shall apply in accordance with applicable regulations.

Article 14 - Support

The Publisher's technical team provides support Monday to Friday, from 8am to 7pm (Paris time), excluding public holidays, exclusively via the contact form available on the Website.
